Cassinelli Studio Legale successfully represented a leading in-house company responsible for granting public contributions and funding before the Regional Administrative Court of Liguria. The firm secured a ruling declaring the appeals against the revocation of two funding grants inadmissible due to lack of jurisdiction.

The ruling reaffirmed the established legal principle that disputes concerning the recovery phase of contributions fall under the jurisdiction of the Ordinary Court. This applies when the revocation is based on the recipient’s alleged non-compliance with the conditions set at the time of disbursement or the confirmed misuse of funds for purposes other than those intended by the financed program—even if the measures in question are formally labeled as revocation, forfeiture, or termination.

The Administrative Court clarified that the appellants, as beneficiaries of the funding, held a fully vested subjective right. Outside cases of exclusive administrative jurisdiction, such rights fall under the jurisdiction of the Ordinary Court rather than the Administrative Court.

The law firm handled the case with a team that included Paolo Mellina Bares.
