Cassinelli Studio Legale successfully assisted one of the main Italian banking groups in relation to the homologation procedure of a minor agreement before the Court of Savona.
Adhering to the Institute’s defensive arguments, the Court rejected the homologation, considering that the proposed plan was penalising for the mortgagee, due to an insufficient valuation of the real estate assets compared to the actual market estimate.
