Cassinelli with a leading banking group in the transaction with the underwriter of an extraordinary administration

Cassinelli Studio Legale assisted a leading Italian banking group in the transaction with an SGR, an investment fund management company, an underwriter in the context of a bankruptcy arrangement of an extraordinary administration.

The transaction had as its object, on the one hand, the borrower’s claim against the bank, ascertained as a result of a bankruptcy dismissal, and – on the other hand – the Institute’s claim against the procedure, amounting to approximately six million euros.

In the face of the waiver of the appeal of the judgment of the Court of Appeal of Rome that defined the bankruptcy revocation, the bank obtained the immediate monetisation of its credit to a significant part of the borrower’s claims.
